Terms of Service

The institutional terms, responsibilities, and standards governing Partner Organizations, FPO Administrators, and Evaluators on FPO Sehat.

Executive Summary for Partners and FPOs
Honest Reporting: All assessment data must reflect verifiable field audits without fictitious inflated scoring.
GPS Verification: Evaluators must allow genuine browser geolocation when onboarding FPOs or submitting assessments.
Data Sovereignty: You retain ownership of institutional records; Grameen Foundation India provides diagnostic frameworks.

1. Acceptance of Terms

By registering, logging in, or accessing the FPO Sehat Diagnostic and Capacity Assessment Portal ("the Portal"), you ("User," "Partner," or "FPO Administrator") agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of an institution, Farmer Producer Company, NGO, or resource institution, you represent that you possess legal authority to bind that entity.

2. Institutional Eligibility & Portal Use

The Portal is designed specifically to assess, diagnose, benchmark, and strengthen Farmer Producer Organizations (FPOs/FPCs) across India. Users must meet the following eligibility criteria:

  • Legitimate Entity: The participating FPO must be an entity registered under the Companies Act, Cooperative Societies Act, or corresponding Indian statute.
  • Authorized Representatives: Evaluators, Resource Institutions, and Partners must maintain active organizational mandate before conducting assessments.

3. User Accounts, Authentication & Responsibility

Each user is responsible for safeguarding their login credentials. Account sharing across unverified third parties is strictly prohibited. Grameen Foundation India cannot and will not be liable for losses resulting from compromised passwords.

  • Partner Administration: Partner Admins oversee their licensed field members and must promptly revoke credentials for departed personnel.
  • Audit Accountability: Actions executed under an authenticated account are attributed to that account holder in the immutable system audit trail.

4. Geolocation Verification & Anti-Spoofing Rules

To maintain the credibility of assessments for financial institutions, donors, and certifying bodies, FPO Sehat enforces physical presence validation:

Anti-Spoofing Clause: Using GPS spoofers, mock location emulators, or VPN geographic disguises to falsify assessment sites constitutes a breach of service. Submissions found to contain falsified coordinates are subject to diagnostic invalidation.
  • Registration Site Stamping: New FPO on-boarding records must capture the legitimate office, block, or cluster location of the registering enterprise.
  • Audit Submission Geostamp: When finalizing a diagnostic evaluation, the assessor’s coordinates are recorded into fpo_reports and mapped on the ISRO Bhuvan GIS portal.

5. Diagnostic Framework, AI Scoring & Intellectual Property

The assessment rubrics, diagnostic scoring algorithms, maturity matrices, AI recommendation engines, and portal software remain the intellectual property of Grameen Foundation India:

  • Diagnostic Purpose: Assessment scores, risk tiers, and capacity-building recommendations represent analytical guidance, not commercial credit guarantees.
  • Proprietary Tool: Users may not reverse engineer, decompile, or harvest the diagnostic criteria for competing commercial software.

6. Partner Licensure, FPO Quotas & Billing

Partner access is provided according to authorized FPO limits and license validity terms:

  • Quota Enforcement: Partners may onboard and assess FPOs up to their licensed capacity (max_fpo_limit). Additional capacity requires quota top-up.
  • License Renewal: Accounts with expired licenses may access historical reports in read-only mode until license renewal is completed.

7. Suspension & Account Termination

Grameen Foundation India reserves the right to suspend or terminate accounts that engage in data falsification, fraudulent quota usage, or violations of applicable Indian statutes. Upon termination, users may request export of raw institutional data within thirty (30) days.

8. Governing Law & Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of India. Any legal dispute, arbitration, or proceeding arising under this agreement shall be subject to the exclusive jurisdiction of the competent courts in New Delhi / Gurugram, India.
